These Terms of Service (“Terms”) govern your access to and use of the ArcQubit platform, applications, website, and related services (collectively, the “Services”). By using our Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Overview
ArcQubit provides a no-code platform for orchestrating cloud, AI, and quantum computing workloads and related data analytics services. Our products include, but are not limited to, the ArcQubit platform, Quantum Exchange Marketplace (QeX), Composer, Supercharge, and User Behavior Analytics (UBA).

2. Eligibility
You must be at least 18 years old or have legal capacity to form a binding contract. Use of ArcQubit for government, research, or enterprise purposes must comply with all applicable export control, cybersecurity, and data handling laws.

3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify ArcQubit immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use
You agree not to:

Use the Services for unlawful, unethical, or discriminatory purposes.

Reverse-engineer, decompile, or modify the platform.

Attempt to gain unauthorized access to ArcQubit systems or data.

Use ArcQubit to distribute malware, spam, or conduct denial-of-service attacks.

Interfere with the operation, security, or performance of the Services.
ArcQubit may suspend access for any user found to be violating these conditions.
5. Intellectual Property
All software, designs, algorithms, documentation, and content provided by ArcQubit are owned by or licensed to ArcQubit Inc. You are granted a non-exclusive, revocable, limited license to use the Services in accordance with these Terms. You retain ownership of any data, configurations, or models you create through the platform.
6. Data and Privacy
Your use of the Services is governed by our Privacy Policy. ArcQubit may process anonymized or aggregated usage data to improve system performance, enhance features, and maintain platform security.
7. Subscription and Payment
Some Services are offered free of charge (e.g., Composer Freemium), while others require paid subscriptions or usage-based fees (e.g., QeX Marketplace, Supercharge). Payment terms will be displayed during checkout. ArcQubit reserves the right to change pricing with reasonable notice.
8. Service Availability
ArcQubit strives for continuous uptime but does not guarantee uninterrupted operation. Maintenance, upgrades, or external provider outages may impact service availability. We will communicate material disruptions whenever possible.
9. Warranties and Disclaimers
The Services are provided “as is” and “as available.” ArcQubit makes no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose. You assume all risk associated with your use of the platform.
10. Limitation of Liability
To the fullest extent permitted by law, ArcQubit shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Services.
11. Termination
You may stop using the Services at any time. ArcQubit may suspend or terminate access if you violate these Terms, misuse the platform, or engage in conduct that could harm the company, its users, or partners.
12. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any dispute will be resolved through arbitration in Austin, Texas, unless otherwise required by law.
